We forget that the one time we need PPE is when everything else has failed – it is your last defense from an injury. When working in proximity with overhead power lines, the climber or aerial-lift operator must wear a Class E helmet (ANSI Z89.1). This means whenever working within 10 feet of ...energized conductors, either secondary or primary overhead power lines. Class E helmets protect against impact injuries but also against electrical shock.

Not all aerial devices may be used in proximity – within 10 feet – of overhead power lines. Aerial devices that are not insulating are specifically labeled with this warning. This does not mean the labels are read or followed. Every year, tree workers are electrocuted when the basket of an uninsulated telehandler or portable lift touches an overhead powerline.

"The start of my sophomore year began as normal; the arboriculture class had been reviewing past material to brush up on our skills and safety knowledge before jumping into hands-on education. But when a question related to our brand-new Vermeer skid steer came up, it became apparent we were ...not going to be able to use it. This was due to a change in the law in Chapter 74 of the Massachusetts General Laws, which establishes the rules under which vocational-technical education is run in the state. The change in the law caused students to lose permission from the state to use hoisting equipment.

The change required students to have a hoisting license before operating any hoisting machinery at all, whereas before, it only applied to derricks, cableways, cranes, elevators and similar equipment, the really large stuff. This has been a problem, since you can’t get a hoisting license unless you are at least 18 years old. Only some senior students are 18. This renders our expensive machinery mostly useless to students for the time being."

DOL’s Independent Contractor Rule in Effect

On March 11, 2024, the Department of Labor's (DOL) Wage and Hour Division's (WHD) final rule for determining whether a worker is an employee or independent contractor under the Fair Labor Standards Act (FLSA) became effective. The ...final rule rescinds DOL’s 2021 regulation that was published at the end of the Trump Administration and establishes a new test to determine worker classification.

The implications of this shift are substantial for tree care employers who use contract workers. Misclassification of employees as independent contractors carries significant liability under the FLSA, which include paying owed wages and overtime, liquidated damages, and attorneys’ fees. TCIA urges employers who rely on contract workers, including climbers, trainers, and CDL truck drivers, to carefully consider the impact of this rulemaking.
